Global Environmental Governance: A Legal Perspective

Global environmental crises are primarily crises of values. Environmental considerations are being ignored by mankind in decision making and human behavior has resulted in the destruction of the environment. The environment has become a focus not only in courses traditionally concerned with geography, environmental science and ecology, but also in agriculture, politics, economics, law, sociology, and philosophy, etc. Almost all the countries in one or the other way have innumerable problems such as poverty, unemployment, economic imbalance, social tension, technological backwardness and ecological imbalance. The nature and dimension of these problems have to be diagnosed and analyzed for bringing appropriate remedial actions. This paper seeks to identify a number of practical steps and the regional initiatives which were taken to foster more efficient and effective environmental regime, making better use of the resources available, and designed in a way that was most helpful to the implementation of international environmental agreements.

 
 
 

Global environmental problems do not respect borders. Environmental issues are now dealt within the broader context of the development process and policies, and the fact remains that during the past 36 years, and especially over the past decade, domestic and international pressures have created a fight back against environmental degradation. During the past decade, concern for environmental issues has increased markedly and many environmental institutions and policies have been created at the international, national and regional levels. Even before the environmental concerns took a serious turn at the international scenario, the issue of protection of the environment was seriously tackled at the regional level by entering into the environmental agreements having a profound effect on the protection of the environment and ecological balance. Nevertheless, these changes have not improved environmental stewardship significantly. The lack of financing, technology, personnel and training, and excessively large and complex legal frameworks are the most common problems. However, it is pertinent to mention that global environmental movements for the protection and improvement of environment are having a profound impact on the States in shaping and developing their own regimes for the protection and improvement of the environment at the national and international levels. It is arguable that considerations relating to the environmental protection of natural resources and sustainable development are steadily increasing in terms of their significance and complexity. This is largely due to the emergence of a comprehensive suite of rules, principles, and legal concepts requiring enhanced protection of various aspects of the natural environment of the States.
