The accelerated development of artificial intelligence (AI) poses new challenges and opportunities for intellectual property (IP) law, particularly regarding authorship, ownership, and patentability. Laws that have traditionally linked creativity and inventiveness to people are being challenged by AI systems that use machine learning, generative models, and autonomous processes to produce art, literature, music, and even inventions without human intervention. This paper raises the question whether AI should be viewed as a tool or as a creator in its own right for purpose of intellectual property rights. The paper addresses important issues in this regard and suggests changes for equitable and efficient IP protection in the AI era through a review of the literature, legal analysis, and comparative study.
